The Register of Damage Caused by the Aggression of the Russian Federation Against Ukraine (RD4U) officially announces the opening of four claims categories for submission by affected individuals.
These categories are:
A4.1 - Loss of access to healthcare
A4.2 - Loss of access to education
The opening of these four categories means that all claims categories for individuals in the Register are now officially launched. This ensures the possibility of fully recording the humanitarian, social, psychological and economic losses of citizens, returning the individual, their rights and their dignity to the center of the compensation process.
From the first day of the full-scale invasion, Russian military aggression has caused devastating blows to the very foundation of human life in Ukraine: the healthcare system is being ruined, millions of children and adults are deprived of their right to a safe education, Ukrainian families are losing their livelihoods and are suffering irreparable moral pain and mental anguish.
Every affected citizen of Ukraine can submit a claim for damage in electronic form through the Diia web portal.
Loss of access to healthcare (Category A4.1)
This category is designed for individuals who, due to the war, lost or were prevented from obtaining access to necessary healthcare services over a sustained period of time, which led to a serious, rapid or irreversible decline in their state of health resulting in intense suffering or a significant reduction in life expectancy. The main causes of such loss of access include the damage or destruction of healthcare facilities (hospitals), unavailability of medical personnel, occupation or physical inability to reach healthcare institutions. In addition to direct harm to health, this category allows claimants to declare financial expenses that citizens were forced to bear to mitigate the risk of their occurrence (such as additional travel costs and higher costs of alternative treatment in other regions).
Loss of access to education (Category A4.2)
This category was designed to record violations of the right to education. Claims can be submitted on behalf of learners (including children through their legal representatives or adults) who were deprived of the opportunity to study over a sustained period of time. This applies to cases of damage or destruction of educational facilities (schools, colleges and universities), physical danger of the educational process or formal prohibitions and discrimination linked to occupation or combat operations. The category covers all levels of learning: compulsory and free primary education, general secondary education, technical and vocational secondary education, higher education on the basis of capacity and adult education.
Other violations of international human rights law, international humanitarian law or laws and customs of war (Category A2.10)
This is a universal category covering mental pain and anguish caused by other violations of international human rights law, international humanitarian law or the laws and customs of war, provided these violations are not already covered by other specific categories (such as the death of immediate family members or serious personal injury). It allows citizens to record and claim their experience of violence or other wrongful acts committed by Russian military and occupying forces both in the territory of Ukraine and outside its territory, if they are directly linked to events in Ukraine.
Other economic losses (Category A3.7)
This category is designed to compensate for property and economic losses sustained by individuals that do not fall within any other relevant claims categories. It covers four broad groups of losses:
- Loss of support: economic losses resulting from the loss of support (meaning any form of contribution to the family welfare, both paid – such as the payment of alimony, dependent and subsistence allowances, pension benefits, insurance benefits – and unpaid) as a consequence of the death, disappearance, deprivation of liberty, forcible transfer or deportation of an immediate family member.
- Medical and burial expenses: medical and burial expenses borne by the claimant and directly related to the death of an immediate family member, including expenses incurred in locating the family member's body and repatriating the remains.
- Movable property of significant value: economic losses resulting from damage, destruction or loss of valuable personal property exceeding ordinary personal belongings (such as vehicles, vessels, aircraft, objects of cultural value or items of exceptional value or rarity lost in connection with the claimant's loss of housing or residence).
- Losses of individual entrepreneurs and self-employed persons: specific economic losses from professional activities that do not fall within categories A3.4 (Loss of gainful employment) and A3.5 (Loss of individual enterprise). These include, but are not limited to, economic losses resulting from damage, destruction or loss of assets owned and used by the claimant in connection with professional activities, as well as documented expenses linked to the evacuation or relocation of the claimant's professional activities.
How to Submit Claims
Claims to the Register can be submitted via the Diia web portal. Diia is a mobile application and web portal created by the Government of Ukraine that provides easy, convenient, and secure online access to digital documents and public services for people and businesses in Ukraine.
