A2.8 and A2.9 – Forcible transfer or deportation of children and adults

Can I submit a claim in this category?

You can submit a claim in this category if:

  1. you (or your child) were expelled from your (or their) residence, or were moved from this residence to another location as a result of coercion;
  2. this was caused by Russia’s full‑scale invasion starting on 24 February 2022; and
  3. the residence from which you (or your child) moved was located within the internationally recognised borders of Ukraine, including the temporarily occupied territories.

The claim will be placed in category A2.8 or A2.9 depending on the Claimant’s age at the time of the forcible transfer or deportation.

You can submit a claim regardless of whether you (or your child) were moved to another location in the territory of Ukraine (forcible transfer) or to the territory of the Russian Federation or any third State (deportation).

The examples below may help you understand whether you (or your child) were forcibly transferred or deported.

Who can submit a claim in category A2.8 on behalf of a minor child (under the age of 18)?

Either parent may submit a claim on behalf of a minor child through Diia.

In the future, an appointed or recognised guardian will also be able to submit a claim on behalf of a minor child through Ukraine’s Centres for Provision of Administrative Services (CPAS), in accordance with the Register’s Rules on the Use of Representatives.

What can I claim under this category?

You can submit a claim for the fact that you were forcibly transferred or deported.

What is the difference between “forcible transfer” and “deportation” for this category?

“Forcible transfer” is when you are forced to move from your residence to another location in the territory of Ukraine, including the temporarily occupied territories.

“Deportation” is when you are forced to move from your residence to the territory of another country.

What are some examples of “forcible transfer” and “deportation” for this category?

“Forcible transfer” or “deportation” could include any of the following:

  1. you were told to move from your residence by the Russian armed forces or persons under Russia’s control who threatened to shoot you if you didn’t leave;
  2. the Russian armed forces or persons under Russia’s control made you leave your residence, put you on a bus, and took you elsewhere;
  3. you were taken from your home by the Russian armed forces or persons under Russia’s control in the temporarily occupied territories, and were held in detention in the Russian Federation; or
  4. when you attempted to leave the area of hostilities or the temporarily occupied territories of Ukraine, you were placed in a filtration camp by the Russian armed forces or persons under Russian control, with subsequent transfer or deportation.

This list is not exhaustive.

Can I submit a claim in this category, if my forcible transfer or deportation took place following the announcement of a mandatory evacuation by the Russian Federation?

Yes. Please include this and all relevant information when you submit your claim.

I do not know the exact address to which I was forcibly transferred or deported. Can I still submit a claim in this category?

Yes. Please provide as much information as possible on your whereabouts after your transfer or deportation.

Can I submit a claim in this category if, after forcible transfer or deportation, I returned or had the opportunity to return to my place of residence?

Yes, you can submit a claim. Please include information concerning your return, or opportunity to return, when you submit your claim.

I was under the age of 18 when I was forcibly transferred or deported, and I am now an adult. Should I submit a claim under category A2.8 for children or category A2.9 for adults?

Due to technical limitations in the Diia platform, you should submit your claim in category A2.9. Diia will automatically identify that the claimant was under 18 at the time of the displacement and will ask the necessary questions.

Do I need to provide evidence related to the amount of compensation for this category?

No, that is not required.

Is this category also for financial losses as a result of the forcible transfer or deportation?

No, if you also experienced financial losses because of the forcible transfer or deportation – such as loss of gainful employment, loss of housing, or other economic losses – you should submit a claim in a different category too.

Does this category also cover other harms that I experienced before or as part of the forcible transfer or deportation?

No, if your claim also relates to one or more other harms, you should submit a claim in a different category too.

How can I demonstrate that the forcible transfer or deportation was caused by Russia’s full scale invasion of Ukraine?

You should provide as much information as possible about the forcible transfer or deportation, including:

  1. the circumstances of the forcible transfer or deportation;
  2. the address of your residence where you were expelled or moved as a result of coercion;
  3. the date or time period that you were forcibly transferred or deported;
  4. any other family members that were forcibly transferred or deported with you; and
  5. your address(es) after the forcible transfer or deportation.

If you are registered with Ukraine’s Register for Individuals Deported or Forcibly Displaced due to the Armed Aggression of the Russian Federation against Ukraine, or with Ukraine’s Register of Information on Children Deported or Forcibly Displaced due to the Armed Aggression of the Russian Federation against Ukraine, you should check to make sure this information is included in your claim too.

However, if you are not included in these Ukrainian Registers or do not have supporting documents, you can still submit a claim to the Register.

For field 14 of the Claim Form, I did not belong to one of the listed groups (member of the military, territorial defence, law enforcement, emergency/utilities/critical infrastructure worker, or medical personnel) at the time of the forcible transfer or deportation. Can I still submit a claim?

Yes. When submitting your claim, you can select that you did not belong to any of these groups.

I have been convicted of a crime in relation to Russia’s aggression against Ukraine, or am subject to sanctions or other equivalent measures imposed by a government or an international organisation. Can I still submit a claim?

Yes. However, you should provide relevant information in the field provided.
