Register of Damage for Ukraine Announces Launch of Claims Categories A.2.8 & А.2.9:  Forcible Transfer or Deportation of Children and Adults

The Register of Damage for Ukraine has officially launched a new claims categories: A2.8 & A.2.9 - Forcible Transfer or Deportation of Children and Adults.

These categories are designated for individuals – both children and adults - who were forcibly transferred within Ukraine or deported outside of Ukraine, caused by the Russian Federation's internationally wrongful acts.

Category A2.8 Forcible Transfer or Deportation of Children is for claims in relation to forcible transfer of children in Ukraine within its internationally recognised borders, included temporary occupied territories, or deportation outside of Ukraine, in particular to the Russian Federation or third countries, on or after 24 February 2022.

A child is an individual who at the time of the event in question was below the age of 18 years unless under the law applicable to the child, majority was attained earlier.

Category A2.9 Forcible Transfer or Deportation of Adults is for claims related to individuals, who also were forcibly transferred within Ukraine or deported outside of Ukraine, caused by the Russian Federation's internationally wrongful acts on or after 24 February 2022.

Claims in categories A2.8 and A2.9 relate to the fact of the forcible transfer or the deportation of children and adults.

To submit a сlaim, an individual needs to provide all information and submit any available evidence of forcible transfer or deportation in support of their сlaims. Some information will be drawn from various existing electronic sources.

One Claim may be submitted by or on behalf of each forcibly transferred or deported person.

At present, claims on behalf of minor children may be submitted by their parents, provided parenthood has been confirmed through the Civil Status Register. Claims on behalf of persons under guardianship may subsequently be submitted through the Centres for Provision of Administrative Services in accordance with the Rules on the Use of Representatives.

How to Submit Claims

Claims to the Register can be submitted via the Diia web portal. Diia is a mobile application and portal created by the Government of Ukraine that provides easy, convenient, and secure online access to digital documents and public services for people and businesses in Ukraine.

The launch of Categories A2.8 and A.2.9 represent another step in recording the damage and losses caused by the aggression of the Russian Federation.
