Claims to the Register can be submitted by individuals, legal entities and the State of Ukraine (including its regional and local authorities, state-owned or controlled entities).

The list of categories of claims that may be submitted to the Register is broad and includes various types of damage, loss or injury. This list has already been approved and is available here.

The Register will be launched in stages. Currently, you can submit a claim in Category A3.1 – Damage or destruction of residential immovable property.

The choice of this category is based on considerations of efficiency and expediency of the development of the Register's digital platform, in particular, given that this category of damage is currently the most digitised in Ukraine and prepared in terms of available evidence of destruction. Also, the launch of this category of claims greatly assists in preparing the technical process for the launch of other more complex categories in the coming months.

From the very outset, those who have applied for assistance under the eRecovery programme and received an Act of Commission’s Review of Damaged and Destroyed Housing issued by local authorities will be able to submit a claim to the Register. In a few weeks, all owners of damaged or destroyed housing, including those located in the temporarily occupied territories, will be able to file claims for compensation.

In Category A3.1 – Damage or destruction of residential immovable property – only the owner of the property can submit a claim, and the ownership must be registered in the State Register of Real Property Rights. If the title to your home is not registered in the State Register of Real Property Rights, you should contact a state registrar or notary, or register it through Diia, if available in your region.

If for some reason it is not possible to register the title to the property, you will have to provide evidence that you have tried to do so but have been refused. In this case, you will be able to provide other evidence that the property is yours. The possibility of submitting a claim in such cases will also be available later.

It will also soon be possible to submit a claim through a representative (including submitting a claim on behalf of minors).

The Register will also have the ability to accept claims from foreign nationals, including in the English language.

Claims for compensation of damage by Russian aggression can be submitted to the Register either through the Diia web portal or the Diia mobile application which can be downloaded here - in Apple Store, here - in Google Play and here - in the Huawei AppGallery.

In order to submit a claim, you will need to fill out an electronic form, provide information about yourself, your home and your ownership of it, as well as how the damage or destruction occurred and the amount of damage.

Those who do not use Diia will also be able to submit a claim. A support system is being developed for this purpose and will be implemented in the near future.

Diia will help you collect as much information as possible by pulling data from other registers and databases. When filling out the electronic claim form, all this information will be automatically displayed in the form. You will also be able to add information and evidence at your disposal by uploading the necessary files and provide a description of them or comments.

The Register of Damage is working to open the possibility to submit claims in all categories as soon as possible. The Register's priority is to receive claims from individuals who have suffered the most from the war, including:

• loss of life and injury
• torture, inhumane treatment, sexual violence, etc.
• deprivation of liberty
• forced displacement of persons
• loss of property and income, as well as other forms of economic damage.

The Register is also working on starting to receive claims related to the damage or destruction of Ukraine's critical infrastructure.

Claims will be processed in two stages.

At the first stage, claims will be checked by the Register's Secretariat for compliance with formal and technical requirements, as well as preliminary assessment of eligibility in accordance with Article 18 of the Claims Rules. At this stage, the Secretariat will also consolidate similar claims into groups that will be reviewed together, to speed up their processing and review.

During the verification process, the Secretariat will apply advanced data processing methods. This may include the use of special software, including artificial intelligence.

After review by the Secretariat, the claims will be considered by the Board of the Register, which has the ultimate authority on recording of claims in the Register. The Board may decide whether or not to record a claim in the Register, or to return it for further review. The claimants will be notified of the Board's decision via Diia.

It should be remembered that the Register does not review the merits of claims, nor does it award or pay compensation to claimants. This will be the mandate of a future compensation mechanism, which is yet to be established. This process will take some time, but Ukraine and its partners have already started working on it.
